Counsel for the PDP, urged the court to allow the appeal and grant the reliefs sought, while Thomas Ojo counsel for the APC, Tinubu and Shettima urged the court to dismiss the appeal.
Ojo argued that the court could no longer assume it’s original jurisdiction under Section 15 of the court’s Act to hear the case on the merit because the constitutionally prescribed 180 days, within which pre-election cases should be heard, has lapsed.
The PDP is seeking the reversal of the January 13 judgment by Justice Inyang Ekwo of the Federal High Court, Abuja which sought to void the nomination of Senator Bola Tinubu and Kashim Shettima as the presidential and vice-presidential candidates of the All Progressives Congress (APC) on the grounds that it (PDP) lacked the locus standi to query how the APC chose it’s candidates.
The PDP had in the suit challenged the validity of the Tinubu/Shettima ticket for the 2023 presidential election, arguing that Shettima’s nomination as the running mate was in breach of the provisions of Sections 29(1), 33, 35 and 84{1)}(2)} of the Electoral Act, 2022 (as amended).
It claimed that Shettima had double nominations, and argued that Shettima’s nomination as a vice-presidential candidate as well as the candidate for the Borno Central Senatorial seat contravened the law.

The Gubernatorial elections Scheduled to hold on the 11th of March 2023 has been postponed to March 18th by the independent Electoral Commission INEC
Following today’s ruling by the Presidential Election Petition Tribunal (EPT) on the reconfiguration of the Bimodal Voter Accreditation System (BVAS) used for the Presidential election held on 25th February 2023, the Commission met to assess its impact on the Commission’s preparations for the Governorship and State Houses of Assembly elections scheduled for Saturday, 11th March 2023.
Nigerians would recall that on 3rd March 2023, the Presidential EPT had given an ex-parte order for some political parties to inspect materials used for the Presidential election, including the forensic inspection of over 176,000 BVAS used in the election which are located in INEC LGA offices across the country. The Commission approached the Tribunal to reconsider the order, given that the BVAS Systems were to be deployed for the Governorship and State Assembly elections and that the lack of a clearly defined timeframe for the inspection could disrupt the Commission’s ability to conduct the outstanding elections. For instance, the BVAS can only be activated on the specific date and time of an election. Having been used for the Presidential and National Assembly elections on 25th February 2023, it is necessary to reconfigure the BVAS for activation on the date of the Governorship and State Assembly elections.
While the ruling of the Tribunal makes it possible for the Commission to commence the preparation of the BVAS for the Governorship and State Assembly elections, it has come far too late for the reconfiguration to be concluded. Consequently, the Commission has taken the difficult but necessary decision to reschedule the Governorship and State Assembly elections which will now take place on Saturday 18th March 2023. By this decision, campaigns will continue until midnight of Thursday 16th March 2023 i.e. 24 hours before the new date for the election.
This decision has not been taken lightly but it is necessary to ensure that there is adequate time to back up the data stored on the over 176,000 BVAS machines from the Presidential and National Assembly elections held on 25th February 2023 and then to reconfigure them for the Governorship and State Assembly elections. This has been the practice for all elections, including the period when the Commission was using the Smart Card Readers.
However, we wish to reiterate that the Commission is not against litigants inspecting election materials. Consequently, it will continue to grant all litigants access to the materials they require to pursue their cases in court.
We wish to reassure all political parties and candidates that the data from the Presidential and National Assembly elections will be backed up and available in INEC cloud facilities, including the INEC Results Viewing Portal (IReV). Political parties can apply for Certified True Copies of the backend data of the BVAS. Also, the results on the BVAS will continue to be available on the IReV for interested parties to access.
We thank Nigerians and friends of Nigeria for their understanding as we continue to deal with these difficult issues and navigate these challenging times.

Wife of the Chinese Ambassador to Nigeria, Liang Huili, wants Nigerian women to give priority attention to girl-child education with a view to fast tracking socio-economic development of the country.
Huili said this during a meeting to highlight the development of Chinese women as part of the activities lined up to mark this year’s International Women’s Day in Abuja.
March 8th of every year is set aside globally to celebrate the social, economic, cultural, and political achievements of women. The day also provides a veritable opportunity to raise awareness about discrimination and take action to drive gender parity.
In Abuja, the wife of the Chinese Ambassador to Nigeria who brought together female journalists to celebrate the day with her, advised women in Nigeria to ensure that the girl- education is taken seriously in the country.
Liang Huili, explained that the major achievements in the Nigeria-China bilateral cooperation in recent years could not have been possible without the full participation of women from both sides.
She also took time to highlight some of policies put in place by the Chinese government to ensure gender parity in all areas of life.
She informed the gathering of women journalists that in China, women’s average life expectancy grew to 79.4 years in 2015, an increase of 10.1 years over 1981 and 42.7 years over 1949 when New China was founded. She said the maternal mortality rate has fallen to 79.4 per cent from 88.8 percent 100,000 in 1990 to 18.3 percent 100,000 in 2018, stressing that China has achieved the United Nations Millennium Development Goals ahead of time.
Liang Huili also told the gathering that a harmony-symphony initiative is in the pipeline for the bilateral exchanges of women between China and Nigeria.
